In these Terms and Conditions (“Terms”), whenever we use “Cared”, “we”, “us”, and “our”, it refers to Cared, and when we use “you” and “your”, it refers to any individual using the Service (as described below).
We provide the Service (as described below) to you via our website ([www.cared.com.hk](http://www.cared.com.hk/), or any subsequent URL that may replace it, hereinafter referred to as the “Website”) and our online content, software, and services (whether accessed from the Website or through the third-party websites, mobile sites, and/or applications). This Service is subject to the following terms and conditions.
General
Access to and use of the Service is subject to these Terms, our privacy policy, and any other terms that we may post on the Service or that may be applicable to our Service from time to time, all of which are incorporated herein by reference. By using the Service, you agree to act in accordance with these Terms, our privacy policy, and any such additional terms. If you do not agree to comply with these or any future Terms or our privacy policy, please do not use or access (or continue to access) the Service.
We are constantly working to improve our services and develop new features. Therefore, we reserve the right to change these Terms from time to time without notice. You should visit this page regularly to view the current Terms so that you are always aware of any revisions that may apply to you. If we make any revisions, we will post them on this page and indicate the most recent revision date of these Terms at the top of this page. The revised Terms will take effect from the date they are posted on the Service. Your continued use of the Service after the effective date of any updated Terms signifies your acceptance of the new Terms.
We reserve the right to suspend, limit, or terminate your access to and use of the Service and/or cancel your account without further notice for any reason.
There are Chinese and English versions of these Terms. If there is any conflict or inconsistency between the Chinese and English versions, the English version shall prevail.
Our Services
Cared provides free and independent online services that allow you to compare physical inspection and medical products provided by third parties. Cared’s business is to identify medical products and services provided by third parties that you may be interested in.
Our comparison services are free. We earn revenue by charging fees and/or commissions to relevant third-party providers for potential customers/business generated.
In addition, we also allow you to get offline help and support (for example, by phone) to get information related to using the service. You can also get support related to physical inspection and medical products or services from third parties. We will not charge you for this service.
**Please remember, any content on the Service should not be construed as medical advice, recommendation or endorsement of specific products or services, and should not be relied upon.** All information contained in the Service is for reference only, and you should not consider it as any advice provided by us. The service information may help you choose the product or service that best meets your needs. However, if you conduct research, seek independent and professional advice and ensure the applicability of the product or service you are interested in, you need to assume sole and absolute responsibility. Ultimately, whether or not to purchase any product or service in our service is a decision made solely and absolutely by you.
Please remember, any content on the “Service” is not, and should not be construed as, an invitation, inducement or suggestion by us or any third party to sell products or services or enter into a contract with you. By providing us with your personal details, you are proposing to request a quote for the relevant product or service from the relevant third party in accordance with the relevant Terms and Conditions. The relevant third party reserves the final right to accept your proposal.
We aim to provide you with uninterrupted access to the current Service. However, we cannot guarantee the continued availability of the Service. We absolutely reserve the right to suspend, limit or terminate your access to the Service at any time.
We reserve the right to provide, modify, delete, edit, interrupt or revise any data, content, material or information displayed on the Service and/or Service at any time without notice. You agree that we will not be liable if you or any third party modifies, suspends or terminates the Service.
Discounts
The discounts provided by Cared are transferred to your designated bank through bank transfer after you have completed the service with the third-party supplier. The provision of discounts needs to meet the following conditions:
– You are booking a physical checkup and medical product through our platform;
– You can provide the official receipt issued by the third-party supplier after the service is completed;
– You can provide a message after the service, the message cannot be less than 50 Chinese characters (or 30 English words);
– You can provide valid bank information;
If the above conditions are met, Cared will pay you the amount of the discount within 30 days after you have completed the service.
Mobile Device Services
The Service includes certain services that can be provided through mobile devices, including (i) the ability to submit information to the Service via a mobile device, and (ii) the ability to browse the Service and the Website from a mobile device (collectively, the “Mobile Device Services”). As long as you access the Service through a mobile device, you may need to pay standard charges, data rates, and other fees to your wireless service operator. In addition, operators may prohibit or restrict the use of certain Mobile Device Services, and not all Mobile Device Services may be compatible with all operators or devices. By using Mobile Device Services and/or providing us with your mobile phone number through the Service, you agree that we may send communications related to our products and services and/or service providers to your mobile device via SMS, MMS, text message or other electronic means. Certain specific information related to your use of your mobile device may be communicated to us. If you change or deactivate your mobile phone number, you agree to immediately update the information you have submitted to us.
Permitted Use
You are only allowed to access and use the Service for personal or non-commercial purposes. This means that only individuals can directly access and use the Service, or legal entities representing such individuals or themselves looking for products or services. Any other form of access and use of the Service mentioned in this paragraph is strictly prohibited.
In order to protect the safety and welfare of others and the integrity and security of our Service, you agree that you will not use the Service (or promote or assist others to use the Service) for the following purposes:
– Engaging in or sharing things that violate these Terms, our policies applicable to the use of the Service, or any contract or warranty;
– In any illegal, fraudulent, inappropriate, unauthorized, harassing, discriminatory, defamatory, threatening, harmful, vulgar, obscene or other offensive manner, or in any manner that may infringe or damage
Your Responsibility
You may complete the registration process during the use of the service. Your username and password should be kept confidential and not disclosed to anyone or shared with anyone. If you choose to share these details, you bear absolute responsibility for all activities carried out on the service with your username and password.
If you need to contact us about the service, you agree to provide and maintain (if applicable) true, accurate, current and complete information about you and/or any other person (such as family members, contacts or beneficiaries related to the product or service). We recommend that you use the tools or forms that appear in our service. Any personal data or other information you submit during the account creation process using our tools or forms or in any other way (including any information you provide about your family), as well as certain other information about you that may be automatically collected when you use the service, is subject to our privacy policy. By providing any information about others (such as family members, contacts or beneficiaries), you warrant and guarantee that you have the right to act on behalf of that person (whether by appointment or by law), and that you have obtained the necessary consent for us to process their personal data in accordance with our privacy policy.
You must take necessary precautions to ensure that any data, content, materials, or information (collectively, the “**User Content**”) you submit or provide to us through the service does not contain any viruses, spyware, malware, or any content that may contaminate, harm, or destructively affect our service, our content (as described below) or third-party websites or any other technology.
You are responsible for your actions on the service and your User Content. You warrant that your User Content does not infringe any privacy rights, ownership rights (such as copyrights, information rights, and trademarks), or other rights of third parties (including confidentiality rights).
In addition, your User Content should not violate any law. User Content should not contain harmful, fraudulent, threatening, defamatory, embarrassing, harassing, infringing, insulting, inflammatory, intimidating, harassing, defamatory, harassing, obscene, indecent, improper, hateful, discriminatory, or racially discriminatory, ethnic discrimination, sexual temptation or other content that is opposed or prohibited by any applicable laws or regulations. We reserve the right to investigate anyone who we confirm to violate this provision and take appropriate legal action, including but not limited to deleting violating content from the service, restricting such violators from accessing the service, and reporting the violator to qualified authorities.
When using our service, you must comply with all applicable laws and regulations. For any injuries, losses, claims, requests, liabilities, or expenses (including reasonable legal fees) that you directly or indirectly caused or related to your access and/or use of the service and/or the accuracy of your submitted and User Content, or related to any intentional, act or non-act, false statement, negligence related to your violation of these terms and conditions, breach of contract or warranty, you agree to bear all responsibility.
For the avoidance of doubt, you are responsible for:
(i) If necessary, ensure and confirm that the credit card (or other payment method) you are using is your credit card, or you have been authorized by the credit card holder (or other payment method) to use the credit card;
(ii) If necessary, ensure and confirm (including by providing proof of identity or other proof documents) that the phone number (or other receiving method) used to receive funds is yours; and
(iii) Comply with any terms and conditions and fees set by any third-party service provider for its provided gateway payment services.
You irrevocably agree to indemnify and hold us harmless from any claim, liability, loss, compensation and expense (including reasonable legal fees) arising out of / related to (i) your use and misuse of our service; (ii) your breach of any provision of these terms and conditions; (iii) your infringement of any intellectual property rights; or (iv) any third party making a claim against us due to the above events (i), (ii) or (iii).
Intellectual Property
You agree and acknowledge that the service may contain or display data, content, images, materials, or information (collectively, the “**Content**”) that are protected by copyright, trademark, patent, trade secret, or other proprietary rights and laws, and are our property and/or the property of our third-party licensors. If you comply with the following conditions, you may print, copy, transfer, or store excerpts of Content, materials, or information displayed in the service, but only for personal use:
– Content must not be used for any business or commercial purpose without our written permission. Without our express written consent, such rights may not be sold, licensed, or transferred to any third party.
– You may not modify or change any Content on the service. Without our written permission, excerpts, copies, publications, uses, reformatting and/or displays for the benefit of other websites must not be made;
– Our and our licensors’ status as the authors of such data, content, materials, or information should always be acknowledged;
– The images, logos, trademarks, or service marks displayed on the service are our property or the property of our third-party licensors, and are protected by applicable copyright laws, trademark laws, privacy and publicity laws, and/or other intellectual property laws. Unauthorized use of the images, logos, trademarks, or service marks displayed on the service may violate applicable laws.
All intellectual property rights, such as patents, trademarks, logos, network domain names, moral rights, data, supply code, software, specifications, proprietary technology, processes, and business strategies, etc. related to and in the service (in all cases, whether or not registered, including all rights for registration, and such content includes data or content displayed in the service), belong to us and/or our licensors, and all such rights are reserved. These terms and conditions or our service do not imply, estop, or otherwise grant you any permission or right to use the content in any way other than as expressly stated in these terms and conditions. Except as mentioned elsewhere in these terms and conditions, you may not use, copy, modify, publish, transmit, sell, excerpt, reverse design, copy, reformat, or distribute the intellectual property rights that we, our licensors have in the service or related to the service without our express written consent.
License for Use of Your Submitted Content
We encourage you to tell us how to improve the service. The service enables you to send us questions, opinions, suggestions, ideas, feedback, or other information (collectively, “Submissions”) about the service through online forms, emails, social media, or other channels. By submitting or otherwise providing your Submission Content to us (including User Content applicable for such purposes), you agree and acknowledge that your Submission Content is non-confidential, and you grant us a non-exclusive, unrestricted, perpetual, irrevocable, transferable, sublicensable, royalty-free
license, which can be used for any purpose, whether for commercial purposes or other purposes, without having to confirm with you or provide compensation. However, personal data will only be used in accordance with our privacy policy.

Jurisdiction

These terms and conditions, and any non-contractual obligations arising from or related to these terms and conditions, shall be governed by the laws of Hong Kong, and you irrevocably agree to be subject to the exclusive jurisdiction of the Hong Kong courts.
